  • Acted for large agri-tech business in high value Commercial Court action against its supplier

  • Acted on the instruction of insurers in the defence of a High Court solicitor’s negligence claim brought by a developer and seeking damages of circa €9m. The claim arose out of a title defect in a conveyancing transaction and the matter was ultimately successfully compromised for under €1m 
  • Acted on the instruction of insurers in the defence of a High Court action claiming €1.5m for alleged damages arising from a large construction project. The matter was referred to mediation where it was successfully compromised 
  • Acted in the successful defence of a High Court application seeking leave of the court for minority shareholders in a private limited company, to issue a derivative action on behalf of that company and in the subsequent defence of the plaintiff’s appeal of that decision to the Supreme Court 
  • Acted for a Board of Management in a construction dispute with a firm of architects and a building contractor which was successful at arbitration
  • Secured one of the first data protection related injunctions in this jurisdiction, as a result of unlawful processing of child data by multinational corporation, eBay
  • Successfully defended an enforcement action by the Data Protection Commission against our client, a national clothes retailer, for alleged breaches of the ePrivacy Regulations 
  • Acted for two separate international clients, who operate in the renewable energy sector, in securing injunctions against alleged creditors who threatened winding up action under the Companies Act 2014 
  • Negotiated a favourable settlement and termination agreement for a Director and Shareholder of an aviation company following a dispute with fellow Shareholders and Directors 
  • Successfully acted for our client, an international engineering company, in an adjudication pursuant to the Construction Contracts Act 2013 
  • Handled a claim on behalf of Barrington’s Hospital involving a landlord and tenant dispute with a physiotherapist whose premises was on site and which was compromised on the best terms available, thereby avoiding a court hearing and an additional layer of costs 
  • Advised a corporate entity both prior to and during a successful mediation with a third level institution. This was in relation to intellectual property rights arising out of a technological transfer agreement between the client and third level institution, protecting the client’s various patents and the exploitation of same via the third level institution into the future 
  • Successfully defended judicial review proceedings for Greyhound Racing Ireland brought by an applicant in the High Court and subsequently Court of Appeal, challenging the issuance of an exclusion order by our client pursuant to section 47 of the Greyhound Industry Act 1958, as amended 
  • Successfully defended long-running injunctive proceedings before the High Court on behalf of a corporate client pursuant to section 160 of the Planning and Development Act, 2000 in respect of the proposed harvesting of kelp in Bantry Bay, Co. Cork 
  • Represented a third level educational institution in a complex defamation dispute before the High Court in connection with issues that arose during the placement of students on work experience in Asia as part of their degree programmes. This case raises very interesting issues of law in respect of the allegation of defamation and the possible defences available, duties owed by a third level provider to its students on placement, the nature of the legal relationship between a third level institution and placement providers as well as issues of jurisdiction and conflict of laws 
  • Successfully resolved a significant dispute with a statutory body involved in the accreditation of certain programmes within our client’s third level educational institution. This matter would have had extremely significant consequences for our client had the accreditation not been forthcoming, as it would have put several of its programme offerings in jeopardy
  • Acted in the first case to come before the High Court Strategic Infrastructure Development List, involving a planning dispute, for a statutory body as a notice party 
  • Acted for a State institution in a landmark Commercial Court procurement matter. This was the first case to come before the Irish courts pursuant to Reg. 32 of S.I. no. 284 of 2016, European Union (Award of Public Authority Contracts) Regulations, 2016 
  • Successful judicial review application to the High Court on the issue of fairness of an employment disciplinary process 
  • Involved in a High Court decision relating to a provision in the MIBI Agreement (which deals with uninsured drivers in accident cases) and as to whether such a provision is governed by and was in accordance with EU Law
  • Acted for a client in a professional negligence matter which we ultimately had dismissed in the High Court and again in the Court of Appeal 
  • Involved in a successful Supreme Court case dealing with the issue of delay in the legal process on behalf of a client 
  • Acted for clients in the Superior Courts in relation to property disputes and recently attended the Land Registry Court under the Registration of Title Act 1964 in order to procure the rectification of title to a property on behalf of an insurer 
  • Acted for a large multi-disciplinary construction group in respect of a Notice served on it by the relevant local authority pursuant to section 23 of the Local Government (Water Pollution) Act 1977 (as amended). The alleged water pollution incident drew significant local and national media attention 
  • Provides risk management advice and litigation services to an international transport group within the context of their expansion in the market.
