The processing of personal data is increasingly a key aspect of investigations into all forms of wrongdoing. If it is not managed properly, it has the potential to provide the subject of investigations with a route to disrupt and frustrate investigations.  We ensure that data protection compliance is considered at all stages of an investigation.

Holmes advise corporate clients on the structures to put in place when commencing an internal investigation, whether in an adversarial or non-adversarial context, and when dealing with evidentiary matters such as protecting legal privilege.

We advise on structuring access to emails in major internal investigations, and we also help clients in developing and implementing internal policies for the use of email and other IT systems.

Routinely representing clients in Data Protection Commission investigations and audits, we are also experienced in advising on complaints from data subjects which may be made in the context of other investigations.
